EV operator duties are the duties that fall on each economic operator in the EV battery chain, from the cell manufacturer to the vehicle manufacturer, the importer, and the distributor, under Chapters VI and VII of Regulation (EU) 2023/1542. The manufacturer must meet design, labelling, conformity, and passport duties for the battery model. The importer must check conformity, labelling, and documentation before placing an imported battery on the market. The distributor must check labelling and documentation and must not make a non compliant battery available. The economic operator that places the battery on the market or puts it into service must ensure that the passport information is accurate, complete, and up to date, and that responsibility cannot be transferred by delegating data work to another party.
An economic operator means a manufacturer, authorised representative, importer, distributor, or fulfilment service provider, as defined in Article 3. The placing operator means the operator that first makes a battery available on the EU market or puts it into service.
How is the EV category decided?
EV operator duties applies to that category, and the record should state the vehicle category, the weight basis, and the reason the battery falls inside the definition. Articles 38 to 46 and 77 is the operative provision for the point in question, and Annex XIII sets the passport content where a passport applies. An importer placing EV batteries from a third country manufacturer on the EU market should not assume that a traction battery for another vehicle type follows the same entry. An importer should hold the declaration of conformity, check the CE marking and labels, verify the passport identifier and QR destination, and record the checks before the first sale, with dates and checkers named.
How are model and individual layers kept separate?
For EV operator duties, the record should keep the two layers separate, with a link from the individual record to the model record. Conformity checks, labelling checks, and the passport responsibility record for a model value should name the test or calculation method and the date, while evidence for an individual value should name the measurement, the date, and the source system, such as the battery management system. Vehicle manufacturers that incorporate EV batteries are subject to duties as manufacturers or as operators placing batteries on the market in the circumstances the Regulation sets out, and the record should state the role relied on for each battery.
How are performance values stated?
For EV operator duties, a capacity value, a power value, a cycle life value, or a capacity retention value should state the test conditions, the reference temperature, the charge and discharge rates, and the end point used. An importer placing EV batteries from a third country manufacturer on the EU market should record which requirement applies to the EV battery in question and which requirement does not, with the article reference. An importer should hold the declaration of conformity, check the CE marking and labels, verify the passport identifier and QR destination, and record the checks before the first sale, with dates and checkers named.
How is use phase information recorded?
For EV operator duties, state of health, cycle count, temperature history, and fault history, where recorded, should be tied to the unique identifier and dated, so a later reader can see the sequence. Conformity checks, labelling checks, and the passport responsibility record should include the data extraction date and the version of the software or method used, where that information is available. Vehicle manufacturers that incorporate EV batteries are subject to duties as manufacturers or as operators placing batteries on the market in the circumstances the Regulation sets out, and the record should state the role relied on for each battery.
How are repair and second life operations distinguished?
For EV operator duties, the record should name the operation, the operator who carried it out, the date, the parts changed, and the tests applied after the operation. An importer placing EV batteries from a third country manufacturer on the EU market should check whether a new passport, a linked passport, or an updated passport is required for the operation, and should record the reasoning. An importer should hold the declaration of conformity, check the CE marking and labels, verify the passport identifier and QR destination, and record the checks before the first sale, with dates and checkers named.
How is access and handover handled?
For EV operator duties, the passport access rules in Article 77 set different levels for the public, for persons with a legitimate interest, and for authorities and notified bodies, and the record should not promise wider access than the Regulation allows. Vehicle manufacturers that incorporate EV batteries are subject to duties as manufacturers or as operators placing batteries on the market in the circumstances the Regulation sets out, and the record should state the role relied on for each battery. An importer placing EV batteries from a third country manufacturer on the EU market should retain the handover record with the identifier, so a later dispute can be traced to a dated transfer.
How is an importer check recorded for one shipment?
An importer check for one shipment starts with the shipment identifier, the battery model, and the manufacturer. The checker reads the declaration, checks the CE marking and labels on a sample, scans the QR code, and verifies the passport identifier. A worked check record shows the shipment, the sample identifiers, the documents checked, and the result for each check, with the checker and date. A shipment with a correct declaration but a QR code that resolves to the wrong model fails the check, and the shipment is held until the destination is corrected. The check record is filed by shipment, so a later question about that shipment can be answered from the file, not from memory.
| Operator | Core duty | Record |
|---|---|---|
| Manufacturer | Design, conformity, passport data | Declaration, technical file |
| Importer | Pre placing checks | Check record, date |
| Distributor | Labelling and document checks | Check record, date |
Duties follow the role, not the job title, and a record that names only a company without naming its role cannot show which duty was met.
