What Guidance Publications Should Be Watched?

Guidance, JRC methodology and standards publications should be logged with date, subject and duty map effect, and the duty map reviewed after each publication.

GUIDE / THE 2027 MILESTONEIDENTITY → INFORMATION → EVIDENCE

Guidance publications to watch are the Commission, Joint Research Centre and standards publications that explain, support or implement the Battery Regulation, and that can change the duty map, the data model or the timeline when they appear. Watching guidance is a continuing duty, because guidance publications arrive throughout the implementation period, and a duty map that is not updated after a guidance publication will drift from the current understanding of the Regulation. The watching list in this guide is a framework list, with the publication, the subject and the effect on the duty map to be logged as each publication appears.

Guidance watching differs from delegated act tracking in legal effect. Guidance explains the Regulation and facilitates harmonised application, but it does not create legal duties beyond the Regulation, and it does not constitute an authoritative interpretation, which is for the Court of Justice. A guidance publication should therefore be read as an explanation and a planning input, not as a new duty, and the duty map should be updated to reflect the explanation, with the guidance cited, while the legal duty remains cited to the Regulation article. A plan that treats guidance as law will overstate duties; a plan that ignores guidance will miss the harmonised understanding that authorities will apply.

What Commission guidance should be watched?

Commission guidance to watch includes guidance on removability and replaceability of portable and LMT batteries, guidance on due diligence application where published, guidance on battery passport data points where published, and Commission notices and questions and answers on the Battery Regulation. Each guidance publication should be logged with its date, version, subject and effect on the duty map, and the duty map should be reviewed after publication. A guidance log that lists titles without effects does not support planning, while a log that states the effect on each duty does.

A guidance log entry should state the publication title, the date and version, the articles affected, the duty map changes made, and the review date. An entry without the articles affected cannot be linked to the duty map, and an entry without the duty map changes cannot show whether the guidance was applied. The combined entry allows a later reader to follow the guidance from publication to duty map change, and to check that the change was made. The log should be retained with the duty map.

What Joint Research Centre work should be watched?

Joint Research Centre work to watch includes methodology reports on carbon footprint for industrial, electric vehicle and LMT batteries, work on performance and durability, and work on recycling efficiency and material recovery calculation. JRC reports provide the technical support for delegated acts, and they show the method direction before the act is adopted, which allows preparation to start on the method, with the interim status labelled. A JRC report should be logged with its date, subject, method version and effect on the calculation or test planning, with the interim status stated where the delegated act has not yet adopted the method.

Worked check: a JRC carbon methodology report for industrial batteries is published. The operator logs the report, updates the calculation planning to the JRC method, labels the calculation interim, and sets a review trigger for the delegated act. When the act is adopted, the operator updates the method version to the act version and removes the interim label. A second operator ignores the JRC report, waits for the act, and must then build the calculation from scratch in the period after adoption. The first operator uses the interim period for preparation; the second loses it.

What standards publications should be watched?

Standards publications to watch include harmonised standards for digital product passports, covering data exchange, identifiers, carriers, storage, APIs and interoperability, and harmonised standards for battery testing, performance and safety. Citation in the Official Journal is the event that gives a standard its presumption of conformity effect, and the citation status should be logged with the standard number, the citation date and the requirement covered. A standard that is published but not cited, and a standard that is cited but later superseded, have different effects, and the log should show the citation status, not only the publication date.

Standards watching should be assigned to the technical role that implements the standard, with a review calendar tied to Official Journal citations. A watching duty assigned to a general role will miss a citation that affects a test method. The review should check the citation, the version and the requirement covered, and should update the test matrix where the standard changes a method. The update should be dated and filed with the test matrix.

What registry and catalogue publications should be watched?

Registry and catalogue publications to watch include implementing acts on the passport registry, the registry user guide, and the semantic catalogue for the battery product group. The catalogue defines the data model and vocabulary for battery passports, and its publication is the trigger for finalising the field catalogue, the registry field map and the data exchange implementation. A catalogue publication should be logged with its version, its fields, its effect on the field catalogue and its review date, and the field catalogue should be updated to the catalogue version, with the update dated.

Catalogue watching is critical path work for passport software, because the software cannot be finalised for registry interaction until the catalogue is defined. A software plan that assumes a catalogue version before publication will need rework when the catalogue appears. A plan that builds the data structure to the Regulation and guidance, holds the catalogue dependent fields open, and finalises them on catalogue publication, will minimise rework. The plan should show the held fields explicitly, with the catalogue publication as the review trigger.

What work programme and consultation material should be watched?

Work programme and consultation material to watch includes the Commission ecodesign working plan, the Battery Regulation implementation work programme where published, and Have Your Say consultations on delegated and implementing acts. Consultation material shows the direction of a future act and allows the operator to comment and to plan, with the consultation status labelled as such. A consultation response should be filed with the pipeline log, so that the operator can show that the consultation was considered, whether or not a response was submitted. The response decision should be recorded, with reasons, where a consultation affects a duty.

Consultation watching should be assigned to a named role, with a calendar tied to consultation closing dates. A consultation missed because no role owned the calendar is a lost opportunity to influence and to plan. The calendar should list each consultation, its closing date, its subject and the duty affected, with the review date. The calendar should be reviewed weekly during active consultation periods, with the review dated.

How is guidance watching organised?

Guidance watching is organised as a log, a calendar and a duty map review, with a named owner, a review cycle and a dated update after each publication. As checked on 28 October 2026, the baseline log should record the guidance and JRC work available at that date, with the next review date set for the next expected publication. This guide gives general educational information only and is not individual legal advice. A reader with a specific battery or market decision should check the current Regulation text and any applicable delegated act, as checked on 28 October 2026, before acting.

A reader with a specific battery or market decision should check the current Regulation text and any applicable delegated act, as checked on 28 October 2026, before acting. Guidance is an explanation and a planning input, and the duty map should show the effect of each publication.
